Only the plural "Rebuilding Seminars" is the mark at issue. The singular "Rebuilding Seminar" is descriptive and is excluded from this infringement analysis.

Under the corrected scope, the "competitor uses Bob's mark" / phrase-overlap branch of the infringement theory does not hold against rebuilders.net on the mark itself, because rebuilders.net does not use the plural mark at all in any captured or live source. What remains live and unaffected by this correction is set out in the executive summary below: the "Fisher Rebuilding Seminar™" trademark exposure (a separate registered-style mark apparently held/licensed by RB360, not Bob's mark), the technical rb360.net relationship evidence, the Bruce Fisher lineage / derivative-method claims, the geographic + business overlap, and the inconsistent age-of-business claims (potential Lanham Act §43(a) false-advertising adjunct). Those do not depend on the singular-vs-plural distinction. Counsel should weigh the case on those elements, not on phrase-copying of "Rebuilding Seminars."

Top three evidentiary findings (ranked by counsel-utility, after scope correction)
Note: the original draft ranked the site-wide "Rebuilding Seminar - Self Paced" image alt-text as a top-three finding. Because that text is singular and descriptive, it is now excluded under the corrected scope and no longer appears in this ranking. The three findings below do not depend on the singular-vs-plural distinction.
- The "Fisher Rebuilding Seminar™" usage on rebuilders.net + the rb360.net script-embed link. This is the single most concrete trademark exposure that survives the scope correction. Note this is a different mark ("Fisher Rebuilding Seminar," apparently RB360's), not Bob's "Rebuilding Seminars" mark, so it is a trademark-exposure question for RB360's mark, not evidence that rebuilders.net copied Bob's mark. Either rebuilders.net is an authorized licensee of RB360 (and counsel should verify and obtain the license terms), or they are using a trademark without authorization. /ignition). Conflating the LLC's age with Bruce Fisher's 1975 program is potentially false-advertising-relevant, particularly if Bob's mark is cited as the actual continuous-use lineage. Counsel may want to evaluate Lanham Act §43(a) implications. Unaffected by the scope correction. - Geographic + business overlap with Bob's program (see §7). Same Bruce Fisher methodology, same 10-week format, same source book, same IC 41 service class, Boulder/Front Range overlap.
